This document presents the Terms of Use ("Terms") that govern access to and use of the Grupo Impulse digital platform ("Platform"), offered by IMPULSE EDUCAÇÃO LTDA., a legal entity governed by private law, registered with the CNPJ/ME under No. 37.837.482/0001-49, with headquarters at Av. Carlos Gomes, nº 281, Sala 601, bairro Mon't Serrat, Porto Alegre/RS, CEP 90.480-003 ("Impulse").

The Platform is designed to offer online courses, educational tools and services that train and connect users with potential job vacancies.

These Terms regulate the relationship between the company and users, determining the conditions of use of the services.

Our courses, info-products and content aim to help users acquire knowledge, develop skills and achieve greater autonomy in their educational and professional journeys, promoting personal growth and training for new challenges.

We have prepared this document so that you ("User") are aware of the rules relating to the use of our platform and content, in a simple, clear and objective manner, as provided for herein and in the applicable legislation.

We recommend that you read the conditions set out here carefully and in full, as well as our Privacy Policy and other documents that accompany the purchase of products chosen on the Platform.

1. User Declarations

Conditions of use that must be agreed upon before using the Impulse Platform and its contents.

  1. 1.1) You declare that you are over 18 (eighteen) years of age, civilly capable, or duly authorized/assisted by your legal guardian to use the Impulse Platform and/or access the content and services made available.
  2. 1.2) You express your free, express, informed, and unequivocal agreement to these Terms by registering on the Platform, subscribing to or purchasing any content, accessing our courses and educational tools, and/or using any functionality made available on the Platform.
  3. 1.3) You declare that you have had access to these Terms, that you have read them in full, and that you agree to the conditions described herein.
  4. 1.3.1) If you do not agree with any clause of this document, you must not use the Impulse Platform, access its content, or complete the registration, and you must immediately cease using the services.

  5. 1.4) You are aware that the content provided by Impulse is for educational and informational purposes only and does not constitute any kind of guarantee or promise of financial return, professional success, or employability.
  6. 1.4.1) The information provided must be evaluated by the user before any practical application or decision is made.

  7. 1.5) You are aware and agree that Impulse's courses and tools are intended to assist in personal and professional development, disseminating knowledge in general.
  8. 1.5.1) The application of the content and the achievement of any result depend exclusively on the user, who must make conscious and responsible use of the information provided.

  9. 1.6) You are aware and agree that Impulse is not responsible for any transaction, employment relationship, financial gain, or decision made by you based on the content made available on the platform.
  10. 1.6.1) The connection with potential job vacancies is an additional service that does not imply any guarantee or responsibility for the hiring process.

2. Registration Rules

  1. 2.1) Impulse is a digital platform dedicated to providing online courses and educational tools, with the aim of connecting its users to potential job opportunities.
  2. 2.2) The information provided on the Platform is informative and educational in nature, and it is the user's responsibility to interpret and apply it according to their own analysis.
  3. 2.3) To use Impulse's services, users must create an account on the platform by registering with a login and password.
  4. 2.4) Only people over 18 (eighteen) years of age, civilly capable, or minors duly assisted/represented by their legal guardians, can register.
  5. 2.5) The User undertakes to provide true, complete and up-to-date information during the registration process, and is fully responsible for the accuracy and authenticity of the data provided.
  6. 2.6) The Platform's content can be offered free of charge or for a fee, in different formats, including courses, teaching materials, videos and interactive tools, with terms defined at the time of purchase.
  7. 2.7) Access to contracted content is exclusively through the user's logged-in area on the platform, with the possibility of viewing online or downloading, where permitted.
  8. 2.8) Users must keep their registration information up to date, as outdated or incorrect data may limit or prevent use of the Platform.
  9. 2.9) The login and password are personal and non-transferable. The User is responsible for ensuring the confidentiality of this information and for all activities carried out on their account.
  10. 2.10) For greater protection, it is recommended to create strong passwords, avoiding obvious combinations such as birth dates, sequential numbers or easily discoverable information.
  11. 2.11) Impulse is not responsible for incidents arising from the use of unprotected devices or the negligence of the User in relation to the security of their account.
  12. 2.12) In the event of loss, theft or suspected misuse of their password, the User must immediately change it on the platform. If this is not possible, they must inform Impulse so that the necessary security measures can be taken.
  13. 2.13) Impulse, at its sole discretion, may carry out checks on the data provided by the User, requesting additional documents or information to confirm the authenticity of the registration.
  14. 2.14) If irregularities, false or unverifiable information is found, Impulse may, without prior notice, suspend or cancel the user's registration, without prejudice to other applicable measures.
  15. 2.15) Each CPF can only be linked to one account on the platform. Duplicate accounts are subject to deletion or merger, at Impulse's discretion.
  16. 2.16) Once the registration has been approved, the user will be able to access the platform's logged-in area, use the features available and view the contracted content, including courses, teaching materials and interactive resources.
  17. 2.17) Impulse reserves the right to refuse the creation of accounts or cancel existing accesses in the event of, but not limited to: (a) fraudulent or irregular use of the platform; (b) violation of these Terms of Use or the Privacy Policy; (c) improper sharing of credentials or content.
  18. 2.18) Impulse may monitor the frequency and volume of access to logged-in areas of the platform, the number of downloads or views of content, with the aim of identifying irregular conduct, including sharing credentials or unauthorized reproduction of materials.
  19. 2.19) Any misuse identified is subject to the appropriate administrative and legal measures, including suspension or termination of the account.

3. User Conduct

  1. 3.1) By using the Platform and/or the content provided by Impulse, the User undertakes to:
  2. 3.1.1) Do not create or use more than one access account on the Platform, except when expressly authorized by Impulse.

    3.1.2) Do not use the access credentials of third parties or allow third parties to use your personal account.

    3.1.3) Not to use the contents or tools of the Platform for commercial, advertising or any other purpose that is not aligned with the educational purpose proposed by Impulse.

    3.1.4) Do not disguise or hide the IP (internet protocol) number that identifies your connection to the internet, or adopt practices that aim to mask your location or identity.

    3.1.5) Not interfere with, manipulate or alter the architecture of the Platform in any technical way, including reverse engineering, brute force attacks or the use of bots.

    3.1.6) Not disseminate viruses, malware, or any files that compromise the integrity of the Platform, User data or information made available by Impulse.

    3.1.7) Do not insert illegal content or content that violates the rights of third parties, including, but not limited to, defamatory, discriminatory or violence-inducing material.

    3.1.8) Do not circumvent or attempt to circumvent security mechanisms implemented on the Platform, such as access blocks, download limits or usage restrictions.

    3.1.9) Do not reproduce, copy, distribute or create derivative works from the contents of Impulse, except with express authorization.

    3.1.10) Not to carry out any practice that infringes Brazilian laws, including those protecting intellectual property and copyright.

  3. 3.2) Impulse may make interaction tools available, such as forums, chats or educational lives, aimed at communication between Users or with the Platform team. By using these tools, the User undertakes to:
  4. 3.2.1) Do not engage in abusive practices, such as harassment, stalking, threats or defamation of other Users or members of the Impulse team.

    3.2.2) Do not publish, distribute or share inappropriate content, such as obscene, violent, offensive or contrary to current legislation.

    3.2.3) Do not incite hatred, discrimination or violence based on race, ethnicity, sexual orientation, religion, gender or any other personal characteristic.

    3.2.4) Do not share or disseminate content protected by copyright, unless you are the legitimate owner of such rights.

    3.2.5) Do not insert links or files that compromise the security of the Platform, such as viruses or malicious software.

    3.2.6) Not to use the Media for commercial purposes, such as advertising their own products or services or those of third parties.

    3.2.7) No surveys, competitions or fraudulent schemes, including pyramid schemes or other illegal activities.

    3.2.8) Not collect or store personal data of other Users without explicit consent and in compliance with applicable law.

  5. 3.3) The User acknowledges that they are solely responsible for the use they make of the Platform, as well as for any content they may insert or share on the Platform, exempting Impulse from any liability for damages caused by such actions.
  6. 3.4) Impulse shall not be held liable for damages arising from the improper use of communication resources or from incorrect, incomplete or fraudulent information entered by the User.
  7. 3.5) Breach of any of the provisions of these Terms may result in:
  8. 3.5.1) Immediate suspension or termination of the User's access to the Platform, without prior notice.

    3.5.2) Adoption of appropriate judicial or administrative measures to repair damages or prevent further violations.

    3.5.3) Referral of the case to the competent authorities in the event of an illegal or criminal act.

  9. 3.6) Suspension or termination of access does not exempt the User from complying with any outstanding obligations towards Impulse, including payments or compliance with contractual rules.
  10. 3.7) Impulse reserves the right to monitor all interactions made on the Platform and to remove content that does not comply with these Terms or applicable legislation, without prior notice.

4. Intellectual Property

  1. 4.1) All pages included in the Platform and any and all material made available, unless otherwise stated, are the property of Impulse or any of its licensors. All rights are reserved.
  2. 4.2) The Platform and any material made available on it are protected by Brazilian and international intellectual property laws, including copyright and trademark laws.
  3. 4.3) The content may not be copied, distributed, modified, reproduced, published or used in whole or in part, except for purposes authorized or approved by Impulse in advance and in writing.
  4. 4.4) The User is prohibited from: (i) Copying, reproducing, modifying, distributing, publishing, transmitting, licensing or creating derivative works of the content made available on the Platform without the express written authorization of Impulse; (ii) Using the materials on the Platform for commercial or advertising purposes without prior consent; (iii) Attempting to circumvent any intellectual property protection system implemented by Impulse or its partners.
  5. 4.5) The content made available is exclusively for the personal and non-commercial use of the User, and may not be shared with third parties, unless expressly authorized by Impulse.
  6. 4.6) Simple access to the Platform does not grant the User any license or right over the brands, logos, materials or content made available on it.
  7. 4.7) The improper use of any elements protected by intellectual property rights may result in Impulse taking appropriate legal measures, including compensation for damages and penalties provided for in current legislation.
  8. 4.8) In the event of a suspected infringement of intellectual property, Impulse must be notified via e-mail to contact.us@incimpulse.com, detailing the infringing content and the circumstances of the infringement.
  9. 4.9) Impulse reserves the right to take all necessary legal action to protect its rights, including removing irregular content, requesting compensation for damages and reporting it to the competent authorities.
  10. 4.10) Permission is granted to temporarily download one copy of the Materials on the Impulse website solely for personal, non-commercial transitory viewing only.
  11. 4.11) All materials displayed or made available on the Platform, including graphics, documents, text, sound, video, audio, artwork, software and HTML code, are the exclusive property of Impulse or its content suppliers, who reserve all their intellectual property rights.
  12. 4.12) The Materials are protected by copyright laws and other applicable Brazilian, U.S. and international intellectual property rules, regulations and laws.
  13. 4.13) You may not use, copy, modify, display, delete, distribute, download, archive, transmit, publish, sell, resell, adapt, reverse engineer or create derivative works of the Material, or use the Material on other websites or in any other media without Impulse's prior written consent.
  14. 4.14) This license shall automatically terminate if you violate any of these restrictions and may be revoked by Impulse Group at any time.
  15. 4.15) Upon termination of viewing these materials or upon termination of this license, you must delete all downloaded materials in your possession, whether in electronic or printed format.
  16. 4.16) By accessing the Platform, Users declare that they will respect all intellectual property rights and those arising from the protection of trademarks, patents and/or industrial designs, deposited or registered in, as well as all rights relating to third parties that may be, or are in any way, available on the platform.
  17. 4.17) Simple access to the service does not grant Users any right to use the names, titles, words, phrases, trademarks, patents, images, data and information, among others, that are or may be available on it.
  18. 4.18) Users acquire no rights over the content.
  19. 4.19) It is forbidden to use the content of the platform for commercial, advertising or any other purpose that contradicts the purpose for which it was conceived, under penalty of the applicable sanctions in Law No. 9,610 of February 19, 1998, which protects copyright in Brazil.
  20. 4.20) Users assume any and all liability for the improper use of the information, texts, graphics, brands, images, and any intellectual or industrial property rights of the service.

5. Marketing Content on the Platform

  1. 5.1) Impulse offers its educational content exclusively through its online platform, accessible through the User's logged-in area on the https://academy.beimpulse.com/home Platform.

  3. 5.2) The content includes online courses, teaching materials and interactive tools, made available according to the conditions of purchase or subscription established at the time of contracting.
  4. 5.3) Once payment has been confirmed, the User will have immediate access to the contracted content, according to the term stipulated for each product or service.
  5. 5.4) Content may be accessed exclusively through the User's logged-in area and, where permitted, downloaded for personal use, and may not be reproduced or shared.
  6. 5.5) The prices of courses and other content are clearly indicated on the Platform at the time of purchase and may vary depending on the payment method and conditions chosen by the User.
  7. 5.6) Impulse reserves the right to change the prices of its products and services at any time, respecting the conditions applicable to contracts already signed.
  8. 5.7) Any promotions and discounts will be valid exclusively for the period indicated on the Platform, and in the corresponding advertisement, and will not apply retroactively to purchases made outside the promotional period.
  9. 5.8) Invoices relating to purchases made by the User will be issued in accordance with the periodicity and terms of the contract and will be available for consultation in the Platform's logged-in area.
  10. 5.9) Based on consumer law, in the case of digital purchases and sales, the User has up to 7 (seven) days from the purchase to request a refund in the event of regret, in which case they will be immediately removed from access to the content previously purchased. After this period, there is no right of withdrawal by the User, and the full amount is due.
  11. 5.10) If the User chooses to pay in installments, non-payment of any installment may result in the suspension of access to the contracted content and the inclusion of the User's CPF in credit protection registers (SERASA/SPC) until the debt is settled.
  12. 5.11) The User is aware that the data required to process payments, such as credit card or CPF information, may be shared with payment providers. For more information, please consult our Privacy Policy.
  13. 5.12) Doubts or queries about purchases made can be directed to the User Service Center, available on the Platform or by e-mail to contact.us@incimpulse.com

6. Communication, Notifications and Announcements

  1. 6.1) Impulse may send communications, notifications, notices and announcements to Users, for commercial, informational or institutional purposes, by SMS, e-mail, WhatsApp, Telegram or other electronic means.
  2. 6.2) Impulse will use its best efforts to ensure that communications are sent correctly and received by the User. However, due to the nature of telecommunications systems and external factors, it is not possible to ensure that messages are delivered or received in full.
  3. 6.3) The User agrees to hold Impulse harmless from any liability for failure to send or receive communications due to technical problems, signal limitations or errors in third-party systems.
  4. 6.4) Impulse will use the contact details provided by the User at the time of registration. It is the User's sole responsibility to ensure that this information is always up to date and correct.
  5. 6.5) Impulse is not responsible for communications not received due to incorrect or outdated contact information provided by the User.

7. Privacy Policy

  1. 7.1) These Terms must be interpreted in conjunction with Impulse's Privacy Policy, which details the practices related to the collection, storage, processing and sharing of Users' personal data, under the terms of the General Data Protection Law (Law No. 13,709/2018) and other applicable legislation.
  2. 7.2) For questions, requests or complaints regarding the use of their personal data, the User should contact Impulse via the support e-mail contact.us@incimpulse.com.
  3. 7.3) These Terms and the Privacy Policy may be updated from time to time to reflect changes in the services offered or in accordance with changes in applicable legislation, at any time and without prior notice, so that regular consultations by the User are recommended.

8. Limitations of liability

  1. 8.1) The User understands and agrees that Impulse assumes no responsibility for any guarantees of financial, professional or personal gain that he/she may expect or obtain from the use of the Platform. Any information, materials or examples published by Impulse are merely informative and illustrative and should not be interpreted as a promise of results, a guarantee of success or an indication of future performance. Use of the content and tools made available by Impulse is at the risk of the User, who is solely responsible for the application of the information and the results arising from such use.
  2. 8.2) Impulse will not be liable, under any circumstances, for losses or damages of any nature, including loss of profits, financial losses, moral or material damages, direct or indirect, caused by the improper use of the Platform and its contents. This includes, but is not limited to, the following circumstances: (i) unavailability, errors or failures displayed on the Platform, as well as access difficulties arising from incorrect use by the User or external factors, such as internet connection failures; (ii) unavailability or failures caused by force majeure events, cyber attacks or actions by third parties beyond Impulse's control; (iii) inconsistencies in the transmission of data or information due to the quality or availability of the User's internet connection; (iv) false, incomplete or outdated statements provided by the User during the use of the Platform; (v) the presence of viruses, malware or other harmful elements that compromise the security of the User's computer systems, especially when resulting from the use of unprotected devices or inadequate practices.
  3. 8.3) Impulse is not responsible for any transactions or operations carried out between the User and third parties, including those related to job opportunities, even if facilitated or mentioned on the Platform. The User understands that all interactions with potential employers or partners presented by Impulse occur independently, and there is no agency relationship, intermediation or guarantee on the part of Impulse regarding the success or viability of these connections.
  4. 8.4) The Platform may contain links or references to third-party websites, such as hyperlinks or buttons that direct the User to external content. These third-party sites or services are not controlled or monitored by Impulse, which is not responsible for the materials, information or content published on them, nor for their availability or functionality. The inclusion of links or references on the Platform does not imply any endorsement, sponsorship or support by Impulse, nor does it create any legal or commercial relationship between Impulse and the owners of these sites.
  5. 8.5) The User is solely responsible for accessing such links and is recommended to check the Terms of Use and Privacy Policies applicable to each site before using it.
  6. 8.6) The User agrees to hold Impulse, as well as its parent companies, subsidiaries, affiliates, directors, representatives and collaborators, harmless from any claims, actions, demands or losses, whether direct, indirect or consequential, resulting from the use of the Platform and its contents. This includes, but is not limited to: (i) unlawful acts committed by the User; (ii) violations of these Terms of Use or third party rights; (iii) interactions or transactions carried out through the Platform with other Users or third parties.
  7. 8.7) To the maximum extent permitted by applicable law, Impulse shall not be liable under any circumstances for any direct, indirect, incidental, special, consequential or punitive damages, nor for loss of revenue, data or access to the Platform, even if it has been advised of the possibility of such damages. In the event that any jurisdiction limits or prohibits the exclusion of certain guarantees or the waiver of liability, Impulse's aggregate liability shall be limited to the amount corresponding to the payment made by the User when contracting the Platform services.
  8. 8.8) By continuing to use the Platform, the User undertakes not to seek any legal action against Impulse in relation to financial or personal gain, and exempts Impulse from any responsibility or liability relating to such matters. The User's financial and personal success depends solely and exclusively on how they use the tools and resources offered, and that any results obtained are entirely their responsibility.
  9. 8.9) The User agrees to indemnify and hold Impulse harmless for any losses and damages that may be claimed, including legal expenses and attorney's fees, due to any unlawful act committed by the User on the platform and/or content, whether for violation of these terms, violation of Impulse's intellectual property copyrights, or violation of the rights of third parties.

10. General Provisions

  1. 10.1) Impulse reserves the right to modify these Terms at any time and without prior notice, in particular to adapt them to developments in the service provided, either by drafting new provisions or by deleting or modifying existing ones. We therefore recommend that you check this page periodically.
  2. 10.2) The User's continued use of the Platform following the publication of a revised version of the Terms shall be deemed tacit acceptance of the changes made. If the User does not agree with the new Terms, they must immediately cease using the Platform.
  3. 10.3) Impulse reserves the right to modify the specifications, functionalities and characteristics of the Platform and its contents at any time, with the aim of correcting errors, implementing improvements or complying with legal and regulatory requirements.
  4. 10.4) The User may not assign or transfer the rights and obligations arising from these Terms, in whole or in part, to third parties without the prior written authorization of Impulse. The User also acknowledges that the use of the Platform does not create any relationship of partnership, representation, employment or commercial partnership between them and Impulse.
  5. 10.5) Impulse may assign or transfer the rights and obligations provided for in these Terms to third parties, including, but not limited to: (i) its subsidiaries, affiliates or companies in the same economic group; (ii) acquirers of its operations, equity interests or assets; or (iii) successors arising from corporate restructurings, mergers, acquisitions or any other relevant corporate operation.
  6. 10.6) By accepting these Terms of Use, the User undertakes to comply with all its provisions and not to act contrary to them, and their successors in title shall also be liable.
  7. 10.7) Should any clause, term or provision of this instrument be deemed invalid, illegal or ineffective, such invalidation shall not affect the remaining provisions, which shall remain valid and in full force. Impulse's tolerance of any breach of the conditions set out herein, or any failure to exercise rights guaranteed to it, shall not be construed as a waiver, novation or acceptance of conduct in breach of these Terms.
  8. 10.8) Acts of God and force majeure shall exempt the parties from liability for the fulfillment of obligations, as provided for in applicable Brazilian law.

11. Jurisdiction and Applicable Law

  1. 11.1) This term of use is governed by and fully complies with current Brazilian legislation, including but not limited to the General Data Protection Law (Law No. 13,709/2018).
  2. 11.2) The jurisdiction of the District of Porto Alegre/RS shall be responsible for settling any claims arising from this document.
